Pets in housing societies: what the rules allow

Updated By PetymFacts checked against official sources on

Quick answer

Under the Animal Welfare Board of India's guidelines of 26 February 2015, a housing society or RWA cannot ban pet dogs, even by majority vote, cannot allow small dogs while barring big ones, and cannot stop pets using lifts or charge for it. Owners are asked to leash dogs in common areas and clean up after them.

These guidelines are AWBI's advice under the Prevention of Cruelty to Animals Act, not an Act of their own, and AWBI still lists them as current (checked 21 October 2026). Some cities, such as Mumbai and Noida, have since written the same points into their own pet rules.

Can a housing society ban pets in India?

Not under AWBI's guidelines, which address the question directly.

Word for word

Please bear in mind that even by obtaining consensus, or even if the majority of residents and occupiers want it, residents welfare associations & apartment owners associations cannot legally introduce any sort of 'ban' on the keeping of pet dogs.

Animal Welfare Board of India, Guidelines for Residents' Welfare Associations and Apartment Owners' Associations, 26 February 2015, part I(a) Animal Welfare Board of India

The same part goes on: associations cannot insist that small dogs are acceptable and large ones are not, cannot cite barking as a reason for a ban, and cannot amend their bye-laws to do what the guidelines say they cannot. A general body, it says, "cannot adopt an illegality" even by a complete majority.

What can a society ask for, and what can it not?

AWBI's 2015 guidelines draw the line point by point; Mumbai's 2025 guidelines repeat most of it for BMC areas.

AWBI 2015 guidelinesBMC Mumbai 2025 guidelines
Ban pet dogs by vote or bye-law Animal Welfare Board of IndiaCannotCannot, and applies the same to cats

Where a city has its own rule, follow the stricter of the two. Noida Authority's 2022 policy, for example, says RWAs cannot add restrictions beyond the Authority's own, and asks owners to use the service lift where possible.

Are AWBI's guidelines legally binding?

They are statutory advice, not an Act, but they point to binding law underneath.

AWBI is a statutory body set up under section 4 of the Prevention of Cruelty to Animals Act, 1960, and the 2015 document calls itself an advisory issued under section 9(k) of that Act. An advisory does not create new offences. What it does is tell associations how the law already applies to them.

The binding parts sit in the Act itself. Abandoning an animal "without reasonable cause" where it is likely to go hungry or thirsty is cruelty under section 11(1)(i), and the guidelines warn that an association which pressures an owner into giving up a pet "will actually have abetted violation of law". Section 3 puts a duty of care on every person in charge of an animal.

Cities have also adopted the guidelines. Brihanmumbai Municipal Corporation's guidelines, signed by the Municipal Commissioner on 20 March 2025, say they are issued in line with AWBI's 2015 guidelines and repeat the ban on bans. Noida Authority's pet policy, in force from 12 December 2022, says RWAs and AOAs cannot impose any restriction or rule beyond the Authority's own policy.

What does a society expect from pet owners?

The guidelines that protect owners also ask things of them. Meeting these is the surest way to keep a society on side.

Don’t

What about community dogs and feeders in a society?

Since 2023 the rules make the RWA responsible for arranging feeding, at spots away from children and entrances.

Rule 20 of the Animal Birth Control Rules, 2023 says it is the responsibility of the RWA, AOA or local body's representative to arrange feeding of community animals in their premises, with feeding spots "far from children play areas, entry and exit points, staircase" and at times when children and senior citizens are least about. Where a society and feeders cannot agree, an Animal Welfare Committee chaired by the Chief Veterinary Officer decides the feeding point.

AWBI's letter of 17 July 2025 told RWAs and AOAs to put this into practice and to keep a register of community dogs with their sterilisation and anti-rabies vaccination status. The Supreme Court's order of 22 August 2025 separately bars feeding stray dogs on the streets outside designated spots; the feeding rules page sets out what that means in a gated complex.

Has Maharashtra told societies to adopt a pet policy?

From news reports, not yet an official source.

Reported in the news; Petym could not find the Cooperatives Department's circular itself on an official site.

  • Pune Pulse reported that Maharashtra's Cooperatives Department directed cooperative housing societies to frame a pet policy at their annual general body meeting, in line with AWBI's 2015 guidelines, and that societies may not make bye-laws that contradict national rules or impose fines or special charges over pets. What it means for owners

Know the guidelines, follow the owner's side of them, and put disputes in writing.

If a committee proposes a ban, a lift rule or a size limit, point it to AWBI's 2015 guidelines, which AWBI still lists, and in Mumbai to BMC's 2025 guidelines. Most disputes end once the committee sees the text. Keep your side clean: a leashed, vaccinated, licensed dog whose owner clears up is hard to object to.

Before you buy or rent, read the society's bye-laws and ask about pet rules. BMC's guidelines advise owners to check bye-laws before moving in, and a landlord's own terms are a separate matter from the society's.

If pressure continues, AWBI's own case list shows it writes to parties on complaints such as "Society not allowed pet dogs", citing the 2015 circular. Complaints can be lodged through AWBI's website.

What it means for sitters

A sitter in a society follows the same common-area rules as the owner, and a sitter who hosts pets needs the society's permission.

AWBI's guidelines name "the other care-givers or dog walkers" that owners entrust their pets to when they ask for clean-ups in public premises, and BMC's 2025 guidelines say owners, care-givers or dog walkers must clean up. A sitter walking a client's dog through a society carries the same leash and poop bag as the owner.

For sitters who host pets in their own flat, Petym asks for the housing society's permission for paid pet sitting before listing. The guidelines protect residents keeping their own pets as companions; they do not settle whether a resident may run paid boarding at home, so the society's written permission matters.

During an owner's trip, the sitter is often the person a guard or committee member meets. Carrying a copy of the dog's licence and vaccination record, and the owner's phone number, answers most questions at the gate.

Questions owners ask

Can an RWA ban pet dogs if most residents vote for it?

Not under AWBI's guidelines of 26 February 2015. They say associations cannot introduce any ban on keeping pet dogs even with consensus or a majority, and cannot amend bye-laws to do so, because a general body cannot adopt an illegality.

Can my society stop my dog from using the lift?

AWBI's 2015 guidelines say associations cannot disallow pets from lifts and cannot charge for it. Owners are asked not to object to using an alternate lift if another working lift is conveniently available. BMC's 2025 Mumbai guidelines say the same.

Is the AWBI circular on housing societies from 2014 or 2015?

2015. The current guidelines are dated 26 February 2015, and their preface withdraws the Board's earlier circulars of 1 February 2014 and 20 February 2014. AWBI's guidelines page still listed the 2015 text on 21 October 2026.

Can a society fine me if my dog fouls a common area?

AWBI's 2015 guidelines say associations cannot impose fines or special charges on pet owners without a central or state law requiring clean-ups, though they can ask. Some city rules do fine: MCD Delhi's terms set Rs 500 for not scooping.

Can a housing society insist my dog wears a muzzle?

No, under AWBI's 2015 guidelines, which say associations cannot insist on muzzles. AWBI's 2022 muzzle guidelines add that muzzles are for exceptional situations judged by a registered vet, never for long periods or without supervision.

Do I need my society's permission to host pets as a sitter?

Petym asks sitters who host pets for their housing society's permission for paid pet sitting before listing. AWBI's guidelines protect residents' own companion animals; paid boarding at home is a different activity, so written permission avoids disputes later.
