What did the Supreme Court say about stray dogs?

Quick answer
In Suo Motu Writ Petition (Civil) No. 5 of 2025, the Supreme Court ruled that street dogs picked up are sterilised, vaccinated and returned to their own area, except rabid or aggressive dogs and dogs removed from schools, hospitals, sports complexes, bus stands and railway stations, which go to shelters. Feeding is allowed only at designated spots.
On 19 May 2026 the court upheld these orders and AWBI's November 2025 SOP, allowed euthanasia of rabid, incurably ill or demonstrably dangerous dogs after veterinary assessment, and handed monitoring to the High Courts. The case is still open: the next hearing was listed for 17 November 2026.
What has the court ordered, and when?
Four documents matter. The first was largely changed within eleven days, which is why so many reports conflict.
11 August 2025
A two-judge bench (Justices J.B. Pardiwala and R. Mahadevan) orders Delhi, Noida, Ghaziabad, Gurugram and Faridabad to pick up stray dogs from all localities, keep them in shelters, and not release them back. It asks for a dog bite helpline within a week and shelters for 5,000 dogs to begin with. Supreme Court of India
22 August 2025
A three-judge bench (Justices Vikram Nath, Sandeep Mehta and N.V. Anjaria) keeps the no-release direction in abeyance: dogs are to be sterilised, dewormed, vaccinated and released to the same area, except rabid or aggressive dogs. It orders feeding spaces in every ward and brings every state into the case. Supreme Court of India
7 November 2025
Stray dogs found in educational institutions, hospitals, sports complexes, bus stands and depots and railway stations are to be sterilised, vaccinated and moved to shelters, and not released back to the same place. AWBI is told to issue an SOP within four weeks. Supreme Court of India
19 May 2026
The same three-judge bench dismisses the applications against the 7 November order and AWBI's SOP, adds new directions, and asks every High Court to register its own case to monitor compliance. Supreme Court of India
21 July 2026
AWBI writes to all states asking for strict compliance with the judgment, its SOP of 27 November 2025 and the ABC Rules, 2023, and reminds them that affidavits are due before the High Courts by 7 August 2026. Animal Welfare Board of India
17 November 2026
The date the judgment lists the case next, to receive the High Courts' first consolidated compliance reports. Supreme Court of India
Did the Supreme Court order all stray dogs removed?
No. That was the 11 August 2025 order for Delhi NCR, and it was changed on 22 August 2025.
The 22 August 2025 order says the directions in paras 12(iii) and 12(iv) of the 11 August order, "to the extent that they prohibit the release of the picked up strays, shall be kept in abeyance for the time being", and that dogs picked up "shall be sterilised, dewormed, vaccinated, and released back to the same area from which they were picked up." Dogs infected or suspected to be infected with rabies, and those showing aggressive behaviour, are sterilised and immunised but "under no circumstances should they be released back onto the streets."
The removal order that does stand is narrower. The 7 November 2025 order, as quoted in the 19 May 2026 judgment, makes the municipal body responsible for removing every stray dog found within the premises of an educational institution, a public or private hospital, a sports complex, a bus stand or depot, or a railway station, and says "The stray dogs so picked up shall not be released back to the same location from which they were picked up."
In May 2026 the court held that the PCA Act, 1960 and the ABC Rules, 2023 do not require the re-release of stray dogs inside institutional premises, so its exclusion of those premises from release is consistent with the rules. Outside those premises, release to the same area remains the rule in the ABC Rules, 2023.
What did the 19 May 2026 judgment add?
Directions to the states and union territories, from paragraphs 108 and 111 of the judgment.
- At least one fully functional Animal Birth Control centre in every district, with more where population and area need it. Supreme Court of India
- Anti-rabies vaccine and immunoglobulin kept available in all government medical facilities, with a public health response to dog bites. The 7 November order had already required every hospital to stock them. Supreme Court of India
- Where dog bites are frequent, authorities may take legally permissible measures "including euthanasia in cases involving rabid, incurably ill or demonstrably dangerous/aggressive dogs", after assessment by qualified vets and in line with the PCA Act and ABC Rules. Supreme Court of India
- Officials acting in good faith to carry out the orders are protected: no FIR or criminal complaint should ordinarily be filed against them, unless there is a prima facie case of mala fides or gross abuse. Supreme Court of India
- States to decide, on a reasoned assessment, whether to extend the directions to other busy public spaces. Supreme Court of India
- Every High Court to register a suo motu case as a continuing mandamus and report to the Supreme Court every four months. Supreme Court of India

Questions owners ask
Did the Supreme Court ban feeding stray dogs?
- No. Its 22 August 2025 order bars feeding stray dogs on the streets and tells municipal authorities to create dedicated feeding spaces in every ward, marked with notice boards. People found feeding on the streets outside those spaces can be proceeded against under the relevant law.
Will sterilised stray dogs be released back?
- Yes, in most places. Under the 22 August 2025 order and the ABC Rules, 2023, dogs are released to the same area after sterilisation and vaccination. The exceptions are rabid or aggressive dogs, and dogs removed from schools, hospitals, sports complexes, bus stands and railway stations, which go to shelters.
Does the Supreme Court judgment allow killing stray dogs?
- Only in narrow cases. The 19 May 2026 judgment allows legally permissible measures, including euthanasia, for rabid, incurably ill or demonstrably dangerous dogs, after assessment by qualified vets and within the PCA Act, 1960 and the ABC Rules, 2023. It does not allow killing healthy dogs.
Is the stray dog case over?
- No. The 19 May 2026 judgment handed day-to-day monitoring to the High Courts, asked them to report every four months, and listed the case again for 17 November 2026. Check the Supreme Court's website for any later order before relying on this page.
Do the Supreme Court orders apply to my pet dog?
- No. The orders deal with stray dogs and stray cattle. The ABC Rules, 2023 class pet dogs separately and make their owners responsible for deworming, vaccination and sterilisation. Your city's pet licence and leash rules still apply to you.
Who do I complain to if the orders are not followed?
- Your municipal corporation first, through the helpline the 22 August 2025 order asked each municipal authority to set up. Since the May 2026 judgment, compliance is monitored by your state's High Court in a suo motu case registered for that purpose.
