My neighbour complained about my dog barking, what does the law say?
Updated By PetymFacts checked against official sources on
Quick answer
Barking is not an offence in itself. The Animal Welfare Board of India says barking is a natural form of expression that must be tolerated, and that a housing society cannot cite it as a reason to ban or restrict a pet dog. It also asks owners to make every effort to keep their dog quiet, especially at night.
If barking becomes constant, a neighbour could complain under the public nuisance sections of the Bharatiya Nyaya Sanhita, which replaced the IPC on 1 July 2024. The best answer to a complaint is to find out why your dog barks and fix that, kindly, and to reply to the society in writing.
Is a barking dog against the law in India?
No. AWBI's guidelines for housing societies answer the question directly, and put a duty on owners too.
Word for word
Barking is a natural form of expression for a dog, and must and has to be tolerated in a society. However, incessant barking can disturb neighbors. Hence, pet owners are advised to make every effort to keep their dogs quiet, particularly during night hours.
The same guidelines say associations cannot cite dog barking as a valid and compelling reason for any proposed ban or restriction, and cannot ban pet dogs even with a majority vote. Mumbai's municipal corporation repeated both points, almost word for word, in its guidelines signed on 20 March 2025.
Which laws could a neighbour use against a barking dog?
None of them names barking. These are the provisions people cite, read from the official text on 21 October 2026. Whether constant barking meets them is for a magistrate or court to decide.
- BNS section 270, public nuisance
- An act or illegal omission that causes "any common injury, danger or annoyance to the public or to the people in general who dwell or occupy property in the vicinity". It replaced IPC section 268. National Crime Records Bureau, Ministry of Home Affairs
- BNS section 292, punishment
- A public nuisance not punished elsewhere in the Sanhita carries a fine that may extend to Rs 1,000. The BNSS schedule lists it as non-cognizable, so the police cannot investigate it without a magistrate's order. National Crime Records Bureau, Ministry of Home Affairs
- BNS section 293, continuing a nuisance
- Repeating or continuing a public nuisance after a public servant with lawful authority has ordered you to stop: simple imprisonment up to six months, or a fine up to Rs 5,000, or both. This one is cognizable. National Crime Records Bureau, Ministry of Home Affairs
- BNSS section 152, magistrate's order
- Lets a District, Sub-divisional or specially empowered Executive Magistrate order an unlawful obstruction or nuisance removed from a public place. Its only animal clause covers "any dangerous animal", not noise. National Crime Records Bureau, Ministry of Home Affairs
- Noise Pollution (Regulation and Control) Rules, 2000
- Night time is 10 pm to 6 am, and the night limit for residential areas is 45 dB(A). The rules name loudspeakers, horns, firecrackers, construction equipment and sound producing instruments; they do not mention animals. Central Pollution Control Board
What should you do when a complaint arrives?
Match the response to what has actually happened. Keep everything polite and in writing.
If A neighbour mentions it to you
Thank them, ask when the barking happens, and set up a phone camera while you are out. Barking only when you are away often points to separation anxiety, which needs a training plan, not punishment. Separation anxiety in dogs ASPCA
If The society sends a notice threatening a ban or fine
Reply in writing that you are working on the barking, and quote AWBI's 2015 guidelines: barking cannot justify a ban or restriction, and bye-laws cannot override the law. Pets in housing societies Animal Welfare Board of India
If The society says your dog cannot use the lift
AWBI's 2015 guidelines and Mumbai's 2025 guidelines say associations cannot bar pets from lifts; Mumbai's allow advising an alternate lift where one exists. Pets in housing societies Brihanmumbai Municipal Corporation, Veterinary Health Department
If A neighbour files a police complaint for nuisance
Under the BNSS, information about a non-cognizable offence is entered and referred to the magistrate. Take advice from a lawyer and keep your records of training and vet visits. Animal Welfare Board of India
If Someone threatens to hurt or poison your dog
That is a different matter. Killing, poisoning or maiming any animal is a cognizable offence under BNS section 325, and threats can be criminal intimidation under section 351. Animal cruelty law in India National Crime Records Bureau, Ministry of Home Affairs
Why is my dog barking, and what helps?
The fix depends on the cause. These are the types of barking ASPCA describes, with its advice. Start with a vet check, because pain and illness can cause barking too.
| When it happens | What helps | |
|---|---|---|
| Territorial or alarm barking ASPCA | At people, dogs or sounds near the flat: the doorbell, the lift, the corridor | Block the view of the door or window, teach a "quiet" cue and a "go to your spot" routine |
| Attention seeking ASPCA | To get food, play or a walk | Never reward the barking; reward silence and teach a quiet behaviour on cue |
| Greeting ASPCA | When people come home or arrive, with a wagging tail | Keep greetings low key; teach sit and stay at the door |
| Socially facilitated ASPCA | Only when other dogs bark, such as community dogs at night | Keep the dog indoors, play music, distract with treats or play |
| Frustration or boredom ASPCA | When the dog is thwarted, confined or under-exercised | More exercise and company, plus training that builds impulse control |
| Separation related ASPCA | Only when left alone | A gradual plan for time alone, and care so the dog is not alone too long |
ASPCA says never to punish barking caused by fear or anxiety, never to keep a dog quiet with a muzzle for long periods or when unsupervised, and that anti-bark collars are punishment devices it does not recommend as a first choice.
How do you settle it with your neighbour?
Most complaints end with a conversation, not a case. AWBI's guidelines treat barking as something both sides carry: neighbours are asked to tolerate a natural behaviour, and owners are asked to make every effort to keep their dog quiet at night. Showing that you are doing your part is the strongest position you can be in.
Keep a short record: when the barking happens, what you have changed, any vet visit and any trainer's plan. If the barking is worst when you are out, plan your absences around it. A dog left alone for long stretches in a flat often barks from boredom or distress, and ASPCA lists more exercise and social contact as part of the treatment.
How can a Petym sitter help a dog that barks when alone?
When you travel, a sitter who stays in your home or visits during the day means your dog is not alone for hours, which is when separation barking happens. A Petym sitter follows your dog's plan as you write it, including walks, training cues and quiet routines, and sends a daily photo update. Petym is not taking bookings yet; cities open once their sitters have passed Petym's checks.

Questions owners ask
Can my housing society ban my dog for barking?
- No. The Animal Welfare Board of India's 2015 guidelines say associations cannot cite dog barking as a valid reason for any ban or restriction, and cannot ban pet dogs even by majority vote. Mumbai's municipal corporation repeated this in its 2025 guidelines. Owners are still asked to keep dogs quiet at night.
Is dog barking a public nuisance under the BNS?
- The BNS does not mention barking. Section 270 defines public nuisance as common injury, danger or annoyance to the public or people living nearby, and section 292 sets a fine of up to Rs 1,000. Whether a particular dog's barking meets that test is for a magistrate or court to decide.
Can the police take my dog away for barking?
- Nothing in the BNS, the BNSS or AWBI's guidelines provides for seizing a dog for barking. Public nuisance under section 292 is non-cognizable, so the police refer such information to a magistrate. The only animal clause in the BNSS magistrate's nuisance power concerns a dangerous animal.
Do noise pollution rules apply to dog barking?
- The Noise Pollution (Regulation and Control) Rules, 2000 set limits such as 45 dB(A) at night in residential areas, but they name loudspeakers, horns, firecrackers, construction equipment and sound producing instruments. They do not mention animals. Night time under the rules runs from 10 pm to 6 am.
Should I use an anti-bark collar?
- ASPCA calls anti-bark collars punishment devices and does not recommend them as a first choice, and says never to punish barking caused by fear or anxiety. Find out why your dog barks, see your vet to rule out pain, and use reward-based training. A qualified behaviourist can help with stubborn cases.
